“Defendant” is the same as “accused”, but you’re right about the witness thing.
“Spectator” is the same as “Witness”
Actually, in the legal sense, a witness is called upon to testify for or against the defendant, whereas a spectator just watches.

Actually, he got that “get out of court free” pass from his appearance as a witness. He still needs to be a plaintiff, though.
